A question of fairness: Spar

Some applications for retail positions in Spar stores ask about criminal records. We contacted Spar to understand why and the Head of HR confirmed:

 …we do not ask applicants questions regarding Criminal Records and we do not need to (given the nature of our work) undertake DBS checks.

It’s refreshing to see a retailer assess whether they need to ask, given the nature of their business. However:

Please be aware that SPAR UK have one office and 80 office based staff. We do not have any overview or input into recruitment for the wider SPAR Group which is run by the individual Retail Groups and is not directed by SPAR UK.

That means that jobs in Spar stores may continue to be subject to self-disclosure and DBS checks. Those recruiters therefore need to be aware of their obligations under the Rehabilitation of Offenders Act 1974, the GDPR and the DBS Code of Practice.
